What evidence is considered during a trial?

This lesson is part 5 of a sequence of 6 lessons addressing the key enquiry: How well is justice served through the legal system?

Continuing the planning of the simulated trial for next lesson, students investigate the various types of evidence admitted in trials, including testimonial, documentary and physical evidence. They analyse the critical role of evidence in establishing facts and determining guilt or innocence. Students use this information to reflect on pieces of evidence to be used in the simulated trial. Furthermore, students explore the significance of ensuring fair trials to uphold justice and protect individual rights.

Students will work towards answering the following questions:

  1. What types of evidence are used in a trial?
  2. Why can’t all types of evidence be used in a court trial?
  3. Why is it important that everyone is given a fair trial?
