Why do we need criminal and civil law? Lesson 2 of 6

Key stage 4 • Law and the justice system • Model curriculum

Why do we need criminal and civil law?

This lesson is part 2 of a sequence of 6 lessons addressing the key enquiry: Does our legal system protect citizens’ rights?

This lesson introduces students to the distinctions between civil and criminal law, emphasising their roles in protecting rights and ensuring justice within society. Through activities such as scenario analysis, grid completion, and exploring the UK court structure, students learn how each legal system operates and their importance in maintaining societal order. High-profile civil cases, such as the “Wagatha Christie” dispute, are used to illustrate the relevance and visibility of civil law in public life.

Students also examine the court system’s hierarchy, focusing on the Supreme Court’s unique role and its connection to the doctrine of precedent. Interactive tasks, including discussions and labelling exercises, help solidify understanding, while reflection tasks encourage students to articulate the necessity of both legal systems. The lesson is structured to correct misconceptions, foster critical thinking, and link abstract legal concepts to real-world examples, ensuring a comprehensive and engaging learning experience.

Students will work towards answering the following questions:
  1. What is civil law?
  2. What is criminal law?
  3. What is the court structure?
